Terms & Conditions
1. Definitions
The “Company” refers to Celebrate Kentucky Yard Cards.
The “Customer” refers to the individual or organization placing the order.
“Installation” refers to the delivery and setup of yard card displays at the specified site.
The “Installation Date” is the date the display is to be completed.
The “Installation Window” is the 12-hour period from 8:00 PM the night before through 8:00 AM on the Installation Date.
The “Pickup Window” is the 24-hour period beginning at 8:00 PM on the final day of the rental through 8:00 PM the following day.
The “Site” is the property where the yard card is installed, as identified in the order.
The “Order” includes all agreements (verbal, written, or electronic) for yard card services.
2. Our Responsibilities (Celebrate Kentucky)
We will:
Install your yard card display within the stated Installation Window;
Remove the display within the stated Pickup Window.
3. Your Responsibilities (The Customer)
You agree to:
Pay the full amount as stated on the order form or invoice;
Ensure a responsible adult is aware of and monitors the site during the Installation Window;
Provide all necessary access or gate codes before the Installation Date;
Ensure the site is clear of hazards, including animal waste;
Keep pets secured during the Installation and Pickup Windows;
Not attach balloons or other objects to the display (leave that to us!);
Not move or rearrange the yard cards;
Notify your lawncare or landscaping crew not to disturb the display;
Confirm that the installation is compliant with any HOA or local regulations;
Report any errors or issues by 12:00 noon on the day of Installation.
4. Photography Consent
You grant us permission to take photos of your yard card setup and use those photos for promotional purposes, provided we do not include your address or identifying information.
5. Indemnification
You agree to protect and hold Celebrate Kentucky harmless from any claims, costs, or damages resulting from a breach of your responsibilities in this agreement.
6. Weather or Unsafe Conditions
If inclement weather or unsafe conditions prevent installation, you may choose between:
A delayed installation date, or
A full refund.
7. Damage
You are responsible for any damage to the display caused by guests, animals, lawn equipment, or other avoidable causes. Celebrate Kentucky may charge the card on file for repairs or replacement.
8. Disclaimer of Warranties
Celebrate Kentucky provides displays “as-is” and makes no guarantees regarding specific conditions such as weather durability, theft, or display duration beyond what is agreed.
9. Limitation of Liability
Celebrate Kentucky is not liable for:
Loss of enjoyment,
Missed photo opportunities,
Business interruption,
Damages caused by third parties,
Or any indirect, special, or punitive damages.
10. Cancellations
Customer Cancellations: Must be made at least 48 hours before the Installation Window begins to receive a full refund.
Company Cancellations: We reserve the right to cancel with at least 48 hours' notice for any reason (full refund will be issued), or immediately with no refund if you violate the responsibilities listed in Section 3.
Notice: Cancellations must be submitted via email to the address on the order confirmation.
11. Additional Terms
Amendments must be in writing and signed by both parties.
Assignment: You may not transfer your order to someone else without our written permission.
Attorney Fees: If a dispute arises, the winning party may recover legal fees.
Jurisdiction: Kentucky laws apply. Disputes must be resolved in Kentucky courts.
Entire Agreement: This document replaces any prior conversations or agreements.
Severability: If part of this agreement is invalid, the rest still applies.
Survival: Some provisions (like indemnification) continue after the agreement ends.
Independent Contractor: Celebrate Kentucky is not your employee or agent.
